Service Agreement - Medick Healthcare Limited

This section of the site explains the Medick Personal Heart Reporting Service (“the Service“) that you are agreeing to purchase concurrently with the purchase of your Medick Heart Monitor (“MHM 100”)

General

  1. The MHM 100 can only provide useful information to you if it is purchased and used in accordance with the manufacturer’s instructions and operated in conjunction with a service agreement, the terms and conditions of which are set out in this section.
  2. The Reports generated as part of the Services are only as valid as the data collected is accurate. It is essential that you comply with the manufacturer’s instructions and guidelines for operation if you are to obtain a good response and output and a clear-cut Report from our team.
  3. We recognise that you may wish to operate the MHM 100 to provide the Services for up to five (5) persons and you may do this only if you have fully and accurately completed the User and Additional User sections within the “My Account” section of the “Club Medick” part of www.medick.com and have subscribed for the Service.
  4. Provided that you have complied with the manufacturer’s instructions and guidelines, we will process the data supplied by you and produce a Report on that data as promptly as possible and, whenever possible, within 24 hours of your successfully posting the data to the “Club Medick” section of our website being www.medick.com. We will email you if the demand for Reports is such that the 24 hour period is likely to be exceeded.
  5. The data posted will be reviewed by our specialist trained staff who will submit onto the website the Results of the particular data supplied. Concurrently you will be emailed to the email address that you have supplied, notification that the Results are available for access and reading.
  6. The Results will be in the form described in the CD ROM supplied to you with the MHM 100 containing the user manual and other supporting materials.
  7. In the event that you have any questions or concerns about the Report and/or the Results, you should call Medick Customer Support.
  8. As is made clear in all promotional materials, the MHM 100 is not a diagnostic device. It will assist in identifying unusual or abnormal patterns of heart activity that may occur during the period when the MHM 100 is being used to record data. It cannot predict or “second guess“ the future. It may alert you to issues that you should investigate further. If it does, or if you suffer any symptoms that are of concern to you, you should consult with your doctor about your health and condition.
  9. Because the Services involves the review of your data by physicians who specialise in the reading of ECGs, your Report can help you by informing you of your heart’s activity over a longer period than the usual tests available for sale to the general public. This shows a pattern that we observe and comment upon. Knowledge can be a vital factor in determining how you lead your life in the future and can help you remain healthy.
  10. The MHM 100 does not work with every person seeking to use it. This is not because of a defect in the MHM 100 or a potentially adverse condition in the user. There are some people who simply are unable to record data satisfactorily and, consequently, no Report or a qualified Report may have to be issued. Our Customer Support Team will be pleased to help you should this occur. We are happy to refund 100% of the purchase price and the balance of your service agreement payments in such circumstances.
  11. We emphasise that the MHM 100 is not a substitute for seeking medical assistance. We urge you to consult with your doctor immediately should you suffer any symptom that you find worrying irrespective of any Results that you may receive from the Services.
  12. You will have purchased an agreed number of Reports to be supplied over an agreed period. At any time, you may increase the number of Reports by purchasing additional ones listed in the accessories section of our order form or by contacting Medick Customer Support.
  13. If at the end of your agreed period you have unused Reports, you will be notified by email that you must use them within 3 months of the end of your agreed period. Any unused Reports after this time will automatically be cancelled from your account.
